KineCaps · Terms of Service

These Terms are a contract between you and KINE CAPS (“KineCaps”, “we”, “us”). By uploading a video or otherwise using KineCaps you accept them. Last updated: 20 September 2026.

1. Who we are

KineCaps is a captioning service operated by KINE CAPS, a proprietorship (sole proprietorship), registered at C 101, Tara Nagar-C, Jaipur, Rajasthan 302012, India. CIN: Not applicable (proprietorships are not registered under the Companies Act). Contact: grievance@kinecaps.com, +91 73403 01557.

2. Eligibility and acceptance

You must be at least 18 years old to use KineCaps. If you use KineCaps on behalf of a business or client, you confirm you are authorised to accept these Terms for them and to upload any footage you submit.

3. The service

You pick a video. Our speech-recognition model transcribes it in your browser, you choose a caption style, edit words and timings, and your browser renders a finished MP4. We also provide subtitle files (SRT/VTT) and a quick editor for fine-tuning.

Captions are produced by an automated model. Automatic transcription is good, not perfect: names, technical terms and mixed-language speech can be misheard. You are responsible for reviewing the output before you publish it. Your video is processed on your own device and is never sent to us; see the Privacy Policy for exactly what is stored where, and for how long.

4. Your account

KineCaps needs no account to be used. If you choose to sign in, it is through Google (via Firebase Authentication) and is entirely optional. Your projects never depend on it. Keep your Google account secure; we may block sign-ins used for abuse, fraud, or in breach of these Terms or the Acceptable Use Policy.

5. Your content and the licence we need

You keep all rights to the videos, audio and text you work with, and to the rendered output. Your files are processed inside your browser (decoding, transcription, caption styling, editing, rendering) and are not transmitted to us; the providers listed in the Privacy Policy serve the website itself and never receive your media. Working files stay in your browser’s own storage and are deleted automatically 3 hours after your last change.

You confirm that you own or have all necessary rights and permissions for everything you upload, including music, footage, trade marks, voices and performances, and that anyone identifiable in your video has consented to the use you are making of it. Do not upload other people’s work without permission.

6. Plans, minutes and payment

KineCaps bills in rendered minutes: one minute of video actually rendered to a file. Uploading, transcribing, re-styling, editing and downloading subtitles are unlimited and free. A render that fails does not consume minutes. Minutes are measured from the video file itself, not from what your device reports.

  • Free plan: 5 rendered minutes per calendar month, longer videos limited by plan; no card required.
  • Paid plans and top-ups: as published on the pricing page at the time of purchase, in your local currency (we bill in INR, USD, EUR, GBP, AUD, CAD or AED). Indian customers are charged in Indian Rupees. Prices include applicable taxes unless stated otherwise at checkout; where tax is added, it is shown before you pay.
  • Top-up minutes do not expire. Subscription minutes reset each calendar month and do not roll over.
  • Recurring payments are collected through our payment gateway (Razorpay) under the RBI framework for e-mandates/UPI Autopay. Where a mandate applies, you receive a pre-debit notification at least 24 hours before each charge, and you can cancel the mandate at any time in your bank or UPI app or by writing to us.
  • Card data never reaches our servers; it is handled by the payment gateway. We store only the payment reference, amount and status.
  • Invoices are emailed for every paid charge, with GST details where applicable.

Refunds and cancellations are governed by our Refund & Cancellation Policy.

7. Fair use

Plans are for your own or your clients’ video production. You may not resell or rebrand the service, or circumvent the plan limits, including by repeatedly clearing your browser storage or using fresh browser profiles to reset your allowance. We may throttle or suspend usage that threatens the security or availability of the service.

8. Acceptable use

You must comply with the Acceptable Use & Copyright Policy, which is part of these Terms. It prohibits, among other things, unlawful, infringing, sexual-content-of-minors, non-consensual and defamatory material, and the use of KineCaps to deceive. We may remove content and block access for breaches.

9. Availability and changes

We aim to keep KineCaps running, but we do not promise uninterrupted or error-free service, and the free plan has no availability commitment. We may add, change or remove features, and may suspend the service for maintenance or capacity reasons. If we make a material change to these Terms we will notify you through the service or by email; continuing to use the service after the change means you accept the updated Terms.

10. Disclaimers

The service is provided on an “as is” and “as available” basis. To the extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that captions will be accurate, complete or suitable for any particular publication, or that a style will render identically on every platform.

11. Limitation of liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim (or the equivalent of about ₹1,000 if you have only used the free plan). We are not liable for indirect, incidental, special or consequential losses, loss of profit, loss of goodwill, or loss of content that you failed to download before its deletion. Nothing in these Terms excludes liability that cannot be excluded or limited under Indian law, including your statutory consumer rights.

12. Indemnity

You agree to indemnify and hold us harmless against claims, damages, losses and reasonable costs arising from your content, your use of the service, or your breach of these Terms or of anyone else’s rights.

13. Suspension and termination

You may stop using KineCaps at any time; the “Delete my data” option in the site menu erases everything stored in your browser for KineCaps. We may suspend or terminate your access immediately if you breach these Terms, if we are required to by law, or if your use creates risk or legal exposure for us or others. On termination, content is deleted under our retention policy, and clauses that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction, subject to any right you have to approach a consumer forum. Before going to court, please write to grievance@kinecaps.com. We will try in good faith to resolve the dispute within 30 days.

15. Notices

Notices to us must be sent to grievance@kinecaps.com or at C 101, Tara Nagar-C, Jaipur, Rajasthan 302012, India. Notices to you may be sent to the email address you write to us from or shown in the service.

16. General

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, Acceptable Use & Copyright Policy and Refund & Cancellation Policy, are the entire agreement between us.

This document is part of the KineCaps agreement set.

KineCaps · Privacy Policy

Short version: your videos never leave your browser. Transcription, captioning and rendering run on your device, your projects live in your browser’s own storage until they auto-delete 3 hours after your last change. Sign-in is optional; if you use it we keep only your Google name, email and account id, in your browser. We do not sell your data, do not advertise to you and do not train AI models on your content. Last updated: 20 September 2026.

1. Who is responsible

KINE CAPS (“KineCaps”) is the data fiduciary for the personal data described here. Registered address: C 101, Tara Nagar-C, Jaipur, Rajasthan 302012, India. Privacy contact and Grievance Officer details are in section 10.

2. What we collect

  • Account data (only if you sign in, through Google and Firebase Authentication): your name, email address and account identifier, held in your browser’s sign-in session; KineCaps runs no account servers of its own.
  • Your video content: the video you pick and the files created from it, transcript, caption groups, a small preview clip, and the rendered MP4, are created and kept in your browser’s own storage. Transcription runs in your browser: the audio is processed on your own device by the open-source Whisper model, and your media is never sent to us at all.
  • Usage and plan data: rendered minutes used and your plan allowance, kept in your browser’s local storage so the limits can be enforced without any account.
  • Payment data: payment reference, amount, status, invoice details, for payments you arrange with us by email. Card numbers, UPI credentials and bank details are collected and stored by our payment gateway (Razorpay), not by us.
  • Technical data: IP address, browser and device information, and error logs, recorded by our hosting and network providers when you load the site, and kept for security and debugging.
  • Support correspondence: messages you send us and our replies. We do not send marketing or promotional email of any kind: we do not collect addresses for that purpose, so there is nothing to unsubscribe from. The only email you could ever receive from us is a reply to something you wrote to us first.

We do not use advertising cookies, tracking pixels, third-party analytics or data brokers in the product, and we do not build advertising profiles of you.

3. Why we process it

  • To provide the service: transcribe your video in your browser, let you edit captions, render the output, and let you download it.
  • To meter the plan allowance in your browser and to process payments and issue invoices.
  • To provide support and to answer your questions.
  • To keep the service secure: preventing abuse, fraud, quota evasion and attacks.
  • To comply with legal obligations (tax, accounting, lawful requests).

We rely on your consent for processing carried out in your browser, which you give by confirming the age notice and using the service, and on legal obligation for records we must retain. You can withdraw consent at any time by using “Delete my data” in the site menu or by writing to us; withdrawal does not affect processing already carried out.

4. Where your data is processed

The website itself is served by our hosting and network providers (listed in section 6), with points of presence in India and abroad, so standard web requests may be processed outside India. Your video and everything derived from it is processed inside your browser and is not transmitted to us or to anyone else. We transfer data only to providers under contract, and we do not transfer personal data to any territory restricted by the Government of India.

All media processing happens on your own device: transcription and rendering run inside your browser using your device’s processor, the video never leaves your device, and the working files stay in your browser’s own storage until they auto-delete (section 5) or you clear them.

5. How long we keep it

  • Videos, audio, transcripts, previews and renders: deleted automatically 3 hours after your last change to the project. There is no archive and no backup of your media. It exists only in your browser; download your output before it expires.
  • Account data: kept in your browser’s sign-in session while you stay signed in; removed when you sign out or use “Delete my data”.
  • Browser storage (plan allowance, preferences): kept until you clear it or choose “Delete my data” in the site menu.
  • Usage, invoices and payment records: kept for accounting, tax and audit purposes for the period required by Indian law (currently up to 8 years).
  • Technical logs: kept for a short period for security and debugging, then deleted or aggregated.

6. Who we share it with

We share personal data only with service providers who process it on our instructions, and only as needed:

  • Google / Firebase, optional sign-in and account identity, held in your browser.
  • Vercel, hosts and serves the website.
  • Cloudflare, DNS and secure network routing.
  • Razorpay, payment processing (when you pay us). Public content CDNs (jsDelivr, Hugging Face), deliver the open-source software and the Whisper model files to your browser when transcription starts; only those standard download requests go to them, never any of your content.

We do not sell your personal data, and we do not share it for advertising. We may disclose data if required by law, a court order or a lawful government request, or to protect the rights and safety of our users and the public.

7. Security

Data is encrypted in transit (HTTPS/TLS). Your media never sits on our infrastructure at all, it exists only in your browser, where it is deleted by an automatic process rather than kept “just in case”. No system is perfectly secure; if a breach ever affects personal data, we will notify you and the Data Protection Board of India as required by law.

8. Children

KineCaps is not intended for children. You must be 18 or older to use KineCaps, and the site asks you to confirm this before you continue. We do not knowingly process the personal data of anyone under 18, and we do not target children with any content or advertising. If you believe a child’s data has reached us, write to grievance@kinecaps.com and we will delete it.

9. Your rights

Under the Digital Personal Data Protection Act, 2023 you have the right to:

  • obtain a summary of the personal data we process about you and how it is processed;
  • correct, complete or update your personal data;
  • request erasure of your personal data, the fastest way is in the app itself: open the site menu (the “min left” chip in the header) and choose “Delete my data”, which erases everything KineCaps has stored in your browser;
  • withdraw consent, at any time, for processing based on consent;
  • nominate another person to exercise your rights in the event of death or incapacity;
  • complain to us, and escalate to the Data Protection Board of India if you are not satisfied.

To exercise any of these, write to grievance@kinecaps.com. We will verify your identity before acting, and respond within the timelines in section 10.

10. Grievance Officer and contact

Grievance Officer: Ritu Sharma. Founder & Grievance Officer. Email: grievance@kinecaps.com. Phone: +91 73403 01557. Address: C 101, Tara Nagar-C, Jaipur, Rajasthan 302012, India. Complaints are acknowledged within 48 hours of receipt.

We acknowledge complaints within 48 hours and resolve them within 30 days, as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020.

11. Changes to this policy

We may update this policy as the service or the law changes. Material changes will be notified in the service or by email before they take effect. The “last updated” date at the top always reflects the current version.

This document is part of the KineCaps agreement set.

KineCaps · Refund & Cancellation Policy

Short version: a failed render never costs you minutes. Cancel a subscription any time and keep access to the end of the period. Unused top-up minutes never expire, and are refundable within 7 days if you have not used them. Last updated: 20 September 2026.

1. Free plan

The free plan costs nothing, so there is nothing to refund. You can stop using it at any time, clear your browser data or use “Delete my data” in the site menu.

2. Renders that fail never consume minutes

We charge minutes only when a render actually produces a downloadable file, and the charge is calculated from the video’s measured duration. If a render fails, no minutes are deducted. If you believe minutes were charged for an output you never received, write to grievance@kinecaps.com with the project name and we will refund or credit those minutes.

3. Cancelling a subscription

You can cancel at any time from the Plans section of the app or by writing to grievance@kinecaps.com. Cancellation stops future charges; your plan stays active until the end of the period you already paid for. We do not charge a cancellation fee. We do not give pro-rata refunds for the unused part of a billing period, except where the law requires otherwise.

4. Refunds on subscriptions and top-ups

  • Top-up minutes: if you have not used any of the minutes, you may request a full refund within 7 days of purchase. If you have used part of them, we may refund the unused portion at the same per-minute rate, at our discretion, within the same 7 days.
  • Subscriptions: once a billing period has started and minutes have been used, that period is not refundable. If you were charged in error, or were charged after cancelling, we refund that charge in full.
  • Duplicate or erroneous charges: refunded in full.
  • Service failure: if a paid feature was unavailable for a significant part of your billing period and we could not fix it, write to us, we will credit or refund the affected period.

Refunds are not available where access was terminated for abuse, fraud or illegal use, or where the request is made in bad faith (for example, after downloading the outputs and claiming non-delivery).

5. How to request a refund

Email grievance@kinecaps.com from the email address you use with us, with the payment reference or invoice number, the date of payment and the reason. We acknowledge every request within 48 hours and resolve it within 30 days. Approved refunds are processed to the original payment method, in the currency you were charged, and typically appear within 5–7 working days, depending on your bank or UPI provider. Where GST was charged, a credit note is issued. Where a payment processor's fee was charged on the original transaction, that fee is not returned to us and may be deducted from the refund.

6. Cancelling a UPI Autopay / recurring mandate

Recurring payments are collected under the RBI’s e-mandate framework. You can cancel the mandate:

  • in the app, under Plans → Manage subscription, or by writing to grievance@kinecaps.com; and/or
  • directly in your bank’s app or your UPI app, where the mandate is registered.

Where a mandate applies, you receive a pre-debit notification at least 24 hours before each charge, as required by the RBI. Cancelling the mandate stops future debits; it does not automatically end your plan, and it does not refund charges already made.

7. Chargebacks

Please contact us before raising a chargeback, we can almost always resolve the issue faster. We cooperate fully with banks and payment gateways investigating a disputed charge, and we may suspend access while a dispute is being examined if there is evidence of abuse.

8. Governing terms

This policy forms part of our Terms of Service and should be read with them. Nothing in it limits your rights under the Consumer Protection Act, 2019. Grievances that are not resolved to your satisfaction can be escalated to our Grievance Officer (grievance@kinecaps.com).

This document is part of the KineCaps agreement set.

KineCaps · Cookie & Storage Policy

Short version: no advertising cookies, no analytics, no tracking pixels. Only the storage needed to remember your editor settings, meter your plan allowance, and hold your projects while you work. Last updated: 20 September 2026.

1. What we use

KineCaps stores a small amount of data in your browser:

  • Sign-in session (Firebase Authentication, in local storage, only if you sign in): keeps you signed in between visits and holds your account id for the plan-allowance ledger.
  • Editor preferences (local storage): panel layout, caption size and position, and similar settings for the caption editor.
  • Plan allowance ledger (local storage): the rendered minutes used this month, so the plan limits can be enforced without any account.
  • Your projects (IndexedDB): the video, transcript, caption edits and renders for projects you start are stored in your browser’s own storage, never on our servers, and auto-delete 3 hours after your last change. Transcription model cache (browser cache/storage): the open-source Whisper model is downloaded once from a public CDN and cached by your browser, so later transcriptions work offline of any server.

These are “strictly necessary” for the service to work. We do not use them to track you across other websites, and we do not sell or share them.

2. What we deliberately do not use

No advertising or remarketing cookies, no third-party analytics or session-recording tools, no social-media pixels, no data brokers. The site ships no analytics code at all.

3. Server logs

Our hosting and network providers record standard access logs (IP address, user agent, requested URL, timestamp) for security, abuse prevention and debugging. These are not used for advertising or profiling.

4. Payments

When you pay, the payment gateway (Razorpay) may set its own cookies or device storage on its checkout pages to secure the transaction and detect fraud. Those are governed by Razorpay’s own policies, not ours.

5. Managing storage

You can clear this data at any time in your browser settings, or choose “Delete my data” from the site menu to wipe everything at once. The first-visit notice shown on the site only records your age confirmation for the privacy policy, it does not switch any tracking on or off, because none exists. You can see it again any time from the site menu under “Consent & cookies”.

This document is part of the KineCaps agreement set.

KineCaps · Acceptable Use & Copyright Policy

This policy forms part of our Terms of Service. Breaking it can lead to content removal and access termination. Last updated: 20 September 2026.

1. Prohibited content

Do not upload, caption, render, store or share material that:

  • is unlawful in India or in your own jurisdiction, or that you do not have the right to use;
  • sexualises or endangers minors in any way, see section 4;
  • is non-consensual intimate imagery, or intimate imagery of anyone without their consent;
  • depicts a real, identifiable person saying or doing something they did not say or do (including synthetic or “deepfake” media) in a way that is misleading, defamatory, or created without their consent;
  • harasses, threatens, defames, doxxes or incites violence or hatred against any person or group;
  • promotes terrorism, or is prohibited by any Indian law, including the Unlawful Activities (Prevention) Act, 1967;
  • infringes copyright, trade marks, performers’ rights, publicity or privacy rights of others, including music, film clips, logos, or footage you do not own;
  • is misleading in a way that could cause harm, for example fake news, manipulated political content, or false medical, financial or legal claims;
  • contains malware, or is designed to disrupt or gain unauthorised access to any system.

2. Prohibited use of the service

  • Attempting to bypass plan limits, quotas, authentication or the render queue.
  • Probing, scanning or attacking our infrastructure, or using it for anything other than captioning and rendering your own videos (including cryptocurrency mining).
  • Reselling or white-labelling KineCaps without our written agreement.
  • Using automated means to upload or render at volumes that degrade the service for other users.

3. Your responsibilities

You are responsible for the material you upload and for the captions and renders you publish. If you caption footage of other people, make sure you have their permission and that your use complies with their rights and any applicable platform rules. If your video contains synthetic or AI-generated media, disclose that where the law or the platform requires it.

4. Child sexual abuse material, zero tolerance

Any material that sexualises minors is strictly prohibited. We report such content and any associated details to law enforcement and to the relevant authorities in accordance with Indian law, and block access immediately. We do not notify the uploader before reporting in these cases.

5. Reporting infringement or abuse (notice-and-takedown)

If you believe content processed through KineCaps infringes your copyright or another right, or is otherwise unlawful, write to grievance@kinecaps.com with:

  • your name, address, phone and email;
  • identification of the work or right you say is infringed;
  • enough detail for us to locate the material (project identifier, URL, or a description);
  • a statement of the right you say is infringed and why the use is not authorised;
  • a declaration that the information you have given is accurate and that you are the rights holder or authorised to act for them;
  • your physical or electronic signature.

We acknowledge reports within 48 hours. Where a report is complete and credible we remove or disable the material, and we may notify the uploader so they can respond. If you believe your content was removed in error, write to the same address with your explanation and we will review it. Access that is repeatedly used to infringe is blocked.

6. Legal orders

Where we receive a court order or a lawful government notification requiring removal of content, we comply within the timelines required by law, 36 hours, or 24 hours where the law requires it, and we may preserve information for the purposes of investigation, as required by the Information Technology Act, 2000 and the rules thereunder.

7. Enforcement

Depending on seriousness, we may warn you, remove content, throttle rendering, suspend access, or terminate it. Unused minutes are not refundable where access is terminated for a breach of this policy. Serious cases, particularly child sexual abuse material, are reported to law enforcement.

This document is part of the KineCaps agreement set.
